Welcome to Inkwell, an AI-powered writing assistant designed to help you write clearly, collaboratively, and creatively. These Terms of Service ("Terms") govern your use of the Inkwell website, app, and all related services ("Inkwell", "we", "us", or "our").

By creating an account or using Inkwell, you agree to these Terms. Please read them carefully.

Using Inkwell

1.1 Eligibility

Anything you create, write, upload, or edit in Inkwell ("Your Content") remains entirely yours. We do not claim ownership over Your Content.

2.2 How We Handle Your Content

By using Inkwell, you grant us a limited licence to process Your Content only as needed to provide the service—such as saving, editing, or improving your document via AI tools. This licence is:

• Non-exclusive
• Revocable
• Solely for providing and improving the Inkwell experience

We do not use Your Content to train AI models. We do not sell or share Your Content with third parties.

Privacy & Data Protection

Your privacy is at the heart of Inkwell. Please refer to our Privacy Policy for full details. Key principles include:

• Documents are encrypted in transit and at rest.
• Only you can access your documents, unless you explicitly share them.
• You have full control to access, export, or permanently delete your data.
• We use privacy-respecting third-party providers that do not retain your data after processing.

AI Content & Responsibility

Inkwell provides AI-generated suggestions and assistance. While we strive for accuracy and usefulness:

• You are solely responsible for how you use AI-generated content.
• We do not guarantee the factual accuracy, legality, or appropriateness of AI outputs.
• AI suggestions should be reviewed and edited with your judgment.

We recommend not relying on Inkwell for medical, legal, or financial advice.

Usage Restrictions

You agree not to:

• Use Inkwell for unlawful, harmful, or abusive purposes.
• Upload or generate content that is defamatory, hateful, or violates others' rights.
• Attempt to reverse engineer, scrape, or interfere with the platform's operation.
• Use the service in a way that may harm the performance or security of our systems.

We reserve the right to suspend or terminate accounts violating these terms.

Plans, Payments & Cancellations

6.1 Free and Paid Plans

Inkwell offers both free and subscription-based tiers. Feature access may vary by plan.

6.2 Billing & Renewals

• Paid plans are billed monthly or annually, depending on your selection.
• Subscriptions auto-renew unless cancelled before the next billing cycle.
• You can cancel or manage your subscription at any time via your account settings.

6.3 Refunds

We offer a 7-day satisfaction guarantee for new subscribers. Beyond that period, refunds are generally not provided unless required by law.

Intellectual Property

7.1 Our Rights

All platform content—including code, branding, UI, and AI functionality—is the intellectual property of Inkwell or its licensors.

You may not copy, modify, or redistribute any part of the service unless expressly permitted.

7.2 Your Feedback

We love your feedback! If you submit suggestions or ideas, you grant us a royalty-free licence to use them for improving Inkwell, without obligation or compensation.

Availability & Service Modifications

We aim for continuous availability but do not guarantee uninterrupted or error-free operation. We may:

• Modify or discontinue features (we'll notify users in advance when possible)
• Perform maintenance, which may result in temporary downtime

We are not liable for any loss resulting from temporary outages or changes.

Termination

You may stop using Inkwell at any time.

We may suspend or terminate your access if:

• You breach these Terms
• Your use poses a security or legal risk
• Required by law or regulatory action

Upon termination, your access will be revoked and data deleted in line with our Privacy Policy.

Disclaimers & Liability Limits

• Inkwell is provided "as is" without warranties of any kind.
• We are not liable for indirect, incidental, or consequential damages arising from your use of the service.
• Our total liability for any claim is limited to the amount you paid in the 12 months prior to the claim.

Nothing in these Terms excludes liability where it would be unlawful to do so.

Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless local laws require otherwise.
